Chairman Jordan Subpoenas As You Sow and GFANZ in ESG Investigation

November 1, 2023
WASHINGTON, D.C. – Today, House Judiciary Chairman Jim Jordan (R-OH) subpoenaed As You Sow, a member of Climate Action 100+,  and the Glasgow Financial Alliance for Net Zero (GFANZ) for documents and communications related to the Committee’s investigation into potential violations of existing antitrust laws through collusive agreements to promote and adopt left-wing environmental, social, and governance (ESG) goals.

The Committee wrote to As You Sow on August 1, 2023, to request that it produce documents and communications related to how As You Sow advances ESG policies, in addition to other information. To date, three months after the Committee's initial requests, As You Sow has not produced a single document in response to the Committee's requests and has made clear that it does not intend to comply voluntarily with the Committee’s requests.

The Committee wrote to GFANZ on July 6, 2023, to request that it produce documents and communications related to how GFANZ advances ESG policies, in addition to other information. GFANZ's initial response in August 2023 and subsequent response in early September 2023 were inadequate, providing limited documents and excluding pre-2022 documents and communications related to GFANZ's founding. Despite discussions with and assurances of cooperation from GFANZ, GFANZ's response without compulsory process has been insufficient and the Committee's requests remain outstanding.
