Chairman Jordan Subpoenas Secretary Mayorkas for Information on Violent Criminal Aliens Allowed Entry by DHS

WASHINGTON, D.C. – Today, House Judiciary Committee Chairman Jim Jordan (R-OH) subpoenaed Department of Homeland Security (DHS) Secretary Alejandro Mayorkas for information and documents related to violent criminal aliens that have been allowed entry into the interior of the country or who may have entered illegally, due to the Biden Administration's open-borders policies.

Since May 2023, the Committee has requested more than 14 A-files for criminal aliens charged with serious crimes, such as theft, brutal assault, murder, and terrorism-related charges. The Committee has followed up on its requests—the vast majority of which have remained outstanding for months on end—regularly and on numerous occasions. In response to the Committee's myriad requests, DHS has merely produced partial summaries for just two A-files, and has acknowledged these limited productions as not responsive to the Committee's requests. On November 13, 2023, the Committee wrote to DHS reiterating its 14 outstanding requests for A-files, asking they be provided by November 27. To date, DHS has failed to provide any of the requested materials, hindering the Committee's ability to fulfill its constitutional oversight obligations.

In addition, Chairman Jordan, Subcommittee on Immigration Integrity, Security, and Enforcement Chairman Tom McClintock, and Subcommittee on Responsiveness and Accountability to Oversight Chairman Ben Cline wrote to Secretary Mayorkas reiterating the Committee's request for information and documents relating to the September 2023 mass illegal alien influx event, where a record-breaking 11,000 illegal aliens were encountered in a single day.  The Committee also requested information about reports that DHS officials cut and removed Concertina wire and fencing installed in Eagle Pass as a deterrent by state and local governments, helping the aliens cross illegally. Committee staff followed up with DHS Office of Legislative Affairs about the status of these requests. To date, however, the Department has not replied or provided an adequate response to requests, and the Committee may be forced to resort to compulsory process if these requests remain outstanding.
