Smith Reaction to Media Reports About Military Commissions

Washington, D.C. – House Judiciary Committee Ranking Member Lamar Smith (R-Texas) issued the following statement in response to media reports indicating that Obama Administration advisers plan to recommend that 9-11 mastermind Khalid Sheikh Mohammed and his co-conspirators be tried in military commissions in the U.S.
Ranking Member Smith: “If the media reports are true, Obama Administration advisers’ recommendation to try 9-11 mastermind KSM and his co-conspirators in military tribunals would be a step in the right direction, but still not enough to ensure that justice is served. Once on U.S. soil, terrorists will be able to petition the courts for additional rights not granted in military commissions or request a trial in federal court. No one knows—including the Obama Administration— how the courts will respond to these petitions.
“I hope that the Obama Administration has finally recognized that military commissions are better equipped to handle the sensitive national security information that is part of terror trials. And I hope that next they will realize that Guantanamo Bay is best equipped for the detention and prosecution of terrorists, not a prison inside the U.S.”
