Judiciary Committee Invites Prosecutor of Texas Children's Hospital Whistleblower to Testify

WASHINGTON, D.C. – The Subcommittee on the Constitution and Limited Government invited Assistant United States Attorney Tina Ansari to testify at a hearing on Wednesday, April 9, 2025, at 2:00 p.m. The hearing will examine the Department of Justice's (DOJ) political prosecution of Dr. Eithan Haim, a whistleblower who exposed Texas Children’s Hospital (TCH) for performing transgender medical interventions on minors, despite an official opinion from the Texas Attorney General that such procedures constituted child abuse under Texas law.

Ansari was the lead prosecutor on Dr. Haim's case but was removed after failing to report a conflict of interest stemming from the substantial financial and political ties her close family members had to TCH.

"The Subcommittee on the Constitution and Limited Government of the Committee on the Judiciary is examining the Biden-Harris Department of Justice's (DOJ) politicized investigation and indictment of whistleblower Dr. Eithan Haim. Dr. Haim revealed that Texas Children's Hospital (TCH) was performing 'transgender medical interventions' on minors contrary to the opinion from the Texas Attorney General that such procedures constitute child abuse under Texas law. As the Subcommittee examines this matter to inform potential legislative reforms, it must first understand the nature of this prosecution, and you, as the primary prosecutor on the case, are uniquely positioned to advance the Committee's oversight. Accordingly, your testimony is requested at a hearing before the Subcommittee on the Constitution and Limited Government on Wednesday, April 9, 2025.

"In May 2023, Dr. Eithan Haim revealed that TCH had continued performing 'transgender medical interventions,' contrary to its March 2022 announcement that these treatments had been paused after the Texas Attorney General's opinion and Texas Governor Greg Abbott’s directive that the Texas Department of Family and Protective Services investigate these procedures as child abuse. While Dr. Haim’s disclosure led Texas to enact bipartisan legislation banning 'transgender medical interventions' for minors, the U.S. Attorney's Office for the Southern District of Texas chose to pursue criminal action against Dr. Haim. On June 17, 2024, prosecutors unsealed a four-count indictment against Dr. Haim for alleged violations of the Health Insurance Portability and Accountability Act, even though he did not disclose patient charts or documents containing personally identifiable information. Dr. Haim faced up to ten years in federal prison and fines totaling $250,000 before his case was dismissed with prejudice on January 24, 2025.

"You were the lead prosecutor on Dr. Haim's case. You allegedly were removed from the case for failing to report an enormous conflict of interest stemming from the substantial financial and political ties your close family members had to TCH. Your family members allegedly attended and cosponsored fundraising events for TCH, yet you apparently did not disclose this relationship at the beginning of the case. This lack of candor and apparent conflict of interest raises further concerns around DOJ's weaponization against Dr. Haim for blowing the whistle on TCH. Your testimony will inform the Committee's legislative reforms aimed at enhancing civil liberties, protecting minors, combatting conflicts of interest, and preventing and prohibiting the weaponization of DOJ to prosecute individuals for holding disfavored viewpoints."
